The protection of your personal data matters to us. This privacy policy explains which personal data we process when you visit and use the website selekt-coaching.com (the “Website”), for what purposes, and what rights you have.

We process personal data in accordance with the Swiss Federal Act on Data Protection (FADP) and, where applicable, the EU General Data Protection Regulation (GDPR). This policy serves to fulfil the information obligations under Art. 19 et seq. FADP and Art. 13 et seq. GDPR.

1. Controller

The controller responsible for data processing on this Website within the meaning of Art. 5 let. j FADP and Art. 4 No. 7 GDPR is:

Selekt Recruitment, Owner Manuel Köck Triemlistrasse 159 8047 Zurich Switzerland Email: manuel.koeck@selekt-talent.ch Telephone: +41 76 406 44 92

2. Provision of the Website and Server Log Files

Each time the Website is accessed, our system automatically collects technical data from the accessing device (e.g. computer, mobile phone, tablet). The following data is processed:

  • Browser type and version
  • Operating system of the device
  • Hostname of the accessing computer
  • IP address
  • Date and time of access
  • Pages and resources accessed (images, files, other content)
  • Website from which you reached our Website (referrer)
  • Notification of whether the access was successful
  • Amount of data transferred

This data is stored in the log files of our system. We do not combine it with other personal data of a specific person and do not use it to identify individual visitors.

Purposes: The processing is necessary to deliver the Website, to ensure its compatibility for as many visitors as possible, to detect and remedy display errors, faults and attacks on our IT systems at an early stage, to optimise the Website and to ensure the security of our systems. Access data is analysed exclusively in non-personalised form for the continuous improvement of our offering and for statistical purposes.

Legal basis: Lawfulness, good faith and proportionality of the processing (Art. 6 FADP) and our legitimate interest in the secure and functional operation of the Website (Art. 6 para. 1 lit. f GDPR).

Storage period: The data is deleted as soon as it is no longer needed for the stated purpose, and at the latest three months after the Website was accessed.

3. Contact Form

If you write to us through a contact form on the Website, we process the information you enter in the form.

Purpose: We use this data solely to handle your enquiry. We may send a confirmation to the email address you provide to let you know your enquiry has been received. We are not obliged to do so; the confirmation serves for your information only.

Legal basis: Your consent by submitting the form (Art. 6 para. 6 FADP; Art. 6 para. 1 lit. a GDPR).

Storage period: Once your enquiry has been dealt with, the data is deleted without undue delay, unless statutory retention periods apply.

Necessity of the information: Use of the form is voluntary. You can also reach us through the other contact options listed on the Website. If you use the form, you must complete the fields marked as mandatory; otherwise we cannot receive or process your enquiry.

4. Online Appointment Booking and Payment (Calendly, Stripe)

Appointments (free initial consultation, strategy session, CV package, mentoring) are booked through the scheduling tool Calendly, provided by Calendly, LLC, 115 E Main St., Ste A1B, Buford, GA 30518, USA (“Calendly”). When you click a booking button on the Website, you are taken to a Calendly booking page. Calendly’s privacy notice applies in addition to this policy: https://calendly.com/legal/privacy-notice.

We process your name, email address, time zone, the appointment you select, the information you enter in the booking form [e.g. phone number, notes], the link to the video call and, for paid packages, order details and payment status. When you open the booking page, Calendly also processes technical data (e.g. IP address, device and browser data) and sets cookies; you can change your cookie settings on the booking page under “Cookie Settings”.

We are the controller for the booking data; Calendly processes it on our behalf under a data processing agreement. For the operation of its own website and cookies, Calendly is responsible itself.

Purpose: We use this data to schedule, confirm and remind you of appointments, to prepare and hold the session and, for paid packages, to process the contract.

Legal basis: Performance of pre-contractual measures at your request and of a contract (Art. 31 para. 2 let. a FADP; Art. 6 para. 1 lit. b GDPR). Optional cookies on the booking page: your consent (Art. 6 para. 6 FADP; Art. 6 para. 1 lit. a GDPR). Retention of payment records: legal obligation (Art. 6 para. 1 lit. c GDPR; Art. 958f CO).

Payment (Stripe): Paid packages are paid through Stripe, a payment service provider whose payment form is integrated into the Calendly booking process. Stripe processes your name, email address, payment method details (e.g. card number), billing details, the amount, the date and the payment status. We receive confirmation of the payment together with your name, email address, the amount and the payment status, but not your full payment card details. Stripe processes this data on our behalf and, for its own purposes of fraud prevention, security and compliance with legal obligations, as an independent controller. For this purpose, Stripe also collects device and browser data when you use the payment form, and it may keep information you enter into the payment form even if you do not complete the payment. Stripe’s privacy policy: https://stripe.com/en-ch/privacy. Prices are charged in US dollars.

Disclosure abroad: Calendly and Stripe process data in the USA and other countries (Stripe also in India). Calendly and Stripe, LLC are certified under the Swiss-U.S. and the EU-U.S. Data Privacy Framework and the UK Extension (see https://www.dataprivacyframework.gov/list), so an adequacy decision covers the transfer (for Switzerland under Art. 16 FADP). Both also use standard contractual clauses. Calendly’s list of sub-processors: https://calendly.com/help/calendly-sub-processors-gdpr-ccpa.

Storage period: Booking data is deleted 12 months after the agreed appointment, unless statutory retention obligations apply (e.g. accounting records for paid packages, 10 years, Art. 958f CO). Stripe retains data in line with its own legal, fraud-prevention and accounting obligations.

Necessity of the information: The mandatory fields and, for paid packages, the payment details are needed to book. If you prefer not to use Calendly, you can arrange an appointment by email at contact@selekt-talent.ch

5. Video Calls (Microsoft Teams / Zoom)

Sessions take place by video call via [Microsoft Teams / Zoom]. The provider processes your name, email address, IP address, audio and video, and chat content during the call, as well as technical data.
Sessions are not recorded.

Legal basis: performance of a contract (Art. 31 para. 2 let. a FADP; Art. 6 para. 1 lit. b GDPR). Personal data may be transferred to the USA; where the provider is certified under the Data Privacy Framework, an adequacy decision covers the transfer.

6. Disclosure of Personal Data to Third Parties

We treat your information confidentially and retain it only for as long as necessary for the respective purpose. We disclose personal data only where there is a legal basis or you have consented, in particular in the following cases:

  • to the providers of technical and payment services named in sections 4, 5, 7 and 8;
  • to debt collection service providers, where we need to enforce outstanding claims;
  • to public bodies and authorities, and to private individuals who are entitled to it under statutory provisions, court decisions or official orders;
  • to authorities for the purpose of initiating legal proceedings or for law enforcement purposes if our legally protected rights are attacked.

7. External Google Services

Our Website uses technical services from Google. The provider is Google Ireland Limited, Gordon House, Barrow Street, Dublin 4, Ireland. Personal data may be transferred to Google LLC, 1600 Amphitheatre Parkway, Mountain View, CA 94043, USA. Where Google LLC is certified under the Data Privacy Framework, an adequacy decision covers the transfer to the USA (for the EU under Art. 45 GDPR; for Switzerland following recognition by the Federal Council). You can verify the certification at https://www.dataprivacyframework.gov/list. Further information on the disclosure of personal data abroad is available on the FDPIC’s website: https://www.edoeb.admin.ch/de/bekanntgabe-von-personendaten-ins-ausland.

When you open pages that use these services, your browser connects to Google’s servers. In particular, your IP address is transmitted. Google may also exchange information between its services in order to provide them; Google is responsible for this under data protection law in its own right. Details are in Google’s privacy policy: https://policies.google.com/privacy. Google offers an opt-out here: https://support.google.com/My-Ad-Center-Help/answer/12155451?hl=de.

Legal basis: Your consent (Art. 6 para. 6 FADP; Art. 31 para. 1 FADP; Art. 6 para. 1 lit. a GDPR). You can withdraw your consent at any time with effect for the future (see section 10).

We use the following services:

Google Fonts. This service provides typefaces so that we can display the Website in an attractive way. Data about the typefaces, the visitor’s IP address and statistics on the use of typefaces are processed. Google Fonts may also be loaded by other Google services embedded on the Website.

Google Cloud APIs. These interfaces allow further Google services to be loaded on the Website, in particular Google Fonts and, where embedded, Google Maps. The IP address is processed in the process.

Gstatic. This is a Google background service that retrieves static content (in particular background data for Google Fonts and Google Maps) in order to reduce bandwidth usage and to pre-load required files.

8. Integration of External Web Services and Processing Outside Switzerland and the EU

We use active content from external providers (so-called web services). When you access our Website, these providers may receive information about your visit, including outside Switzerland and the EU/EEA. You can prevent this by installing a suitable browser plug-in or by deactivating the execution of scripts in your browser. This may restrict the functionality of websites.

9. Data Security and Email Communication

We protect your personal data against unauthorised access by appropriate technical and organisational measures. With unencrypted email communication, we cannot fully guarantee data security on the transmission path. For information requiring a high degree of confidentiality, we therefore recommend encrypted communication or postal mail.

10. Retention and Your Rights

Retention. We store personal data only for as long as necessary for the purposes for which it was collected, as we have an overriding legitimate interest in retaining it, or as we are legally obliged to do so.

You have the following rights:

  • Access (Art. 25 FADP; Art. 15 GDPR): You may request confirmation as to whether we process personal data about you and receive a copy of the data, unless statutory exceptions apply.
  • Rectification (Art. 32 para. 1 FADP; Art. 16 GDPR): You may request that inaccurate data be corrected and incomplete data be completed.
  • Erasure (Art. 17 GDPR; Art. 32 FADP): You may request erasure of your data if it is no longer needed, you have withdrawn your consent and no other legal basis exists, there are no longer legitimate grounds for the processing, the data is being processed unlawfully, or a legal obligation requires erasure. This right does not apply where processing is necessary for the exercise of freedom of expression and information, to comply with a legal obligation, for reasons of public interest, or for the establishment, exercise or defence of legal claims.
  • Restriction of processing (Art. 18 GDPR): You may request restriction if you contest the accuracy of the data, the processing is unlawful and you oppose erasure, we no longer need the data but you need it for the establishment, exercise or defence of legal claims, or you have objected and it is still unclear which interests prevail.
  • Withdrawal of consent: You may withdraw any consent you have given at any time with effect for the future. The lawfulness of the processing carried out until withdrawal is not affected.
  • Objection (Art. 21 GDPR): You may object at any time, on grounds relating to your particular situation, to the processing of your data where it is based on a legitimate interest (Art. 6 para. 1 lit. f GDPR).
  • Data release and portability (Art. 28 FADP; Art. 20 GDPR): You may request that we release to you, or transfer to a controller you name, the personal data that you have provided to us and that we process by automated means on the basis of consent or a contract, in a commonly used, machine-readable format, where technically feasible and where no overriding interests of third parties prevent it.

Exercising your rights. Please contact:

11. Complaints and Legal Remedies

Switzerland. You may at any time report to the Federal Data Protection and Information Commissioner (FDPIC) if you believe that data processing violates data protection rules (Art. 49 FADP). Contact: https://www.edoeb.admin.ch/de/kontakt. You may also take legal action; as a rule, this means an action under Art. 32 FADP in conjunction with Art. 28 et seq. of the Swiss Civil Code (ZGB). For data processing by federal bodies, the procedure is governed by Art. 41 FADP.

EU/EEA. Irrespective of any other remedy, you have the right to lodge a complaint with a supervisory authority (Art. 77 para. 1 GDPR), in the EU Member State of your residence, your place of work or the place of the alleged infringement. The authority will inform you of the progress and outcome of your complaint, including the possibility of a judicial remedy (Art. 78 GDPR).

12. Changes to this Privacy Policy

We may amend this privacy policy at any time, in particular if we change our Website or our data processing. The version published on the Website at the time applies.
